Process analysis and policy development

Oftentimes in law enforcement, written policy and practice come into conflict with each other.  Most times, this is not due to willful disregard, but rather because advancements in process, efficiency or technology are undertaken, but not accounted for in policy. 

Unfortunately, when dealing with the property/evidence function, if either the underlying process is flawed or written agency policy is not followed, the evidence in a case may be in jeopardy of suppression.  Defense attorneys are attune to the idea that the management of evidence is a weak point in most law enforcement agencies and they are becoming more and more likely to exploit this weakness for the benefit of their clients.

The "linear process"

Many operational aspects of law enforcement are dynamic and require varied response.  Fortunately, your PE function does not. 

Operationally, PE is essentially a “linear process”, meaning it only moves forward, beginning with the same definable starting point and ending at at the same definable endpoint.  Additionally, there are not usually surprises in the process along they way, as long as the system itself is set up properly.

It means that as long as adequate policy is in place AND it is being followed, AND the function is regularly maintained, the PE function should flow smoothly! 

 

The problem is that the PE function is behind closed doors and often neglected.  Rarely do agencies have adequate, compliant policy.  Since policy guides the function, it generally churns along haphazardly and unchecked…until there is a problem, which is usually a huge problem, and often results in catastrophic damage to the agency and individuals.
